Legal Question in Medical Leave in Texas

Basis for abondonment

My fiance's daughter has been left at her grandmothers for months now and the mother lives in her own apartment and only visits. My fiance is willig and able to care for his child and so am I but the grandmother wont allow it and we rarely get a chance to talk to the mother b/c she isnt hardly around. Is there any legal action we can take to gain custody of her? There have been many circumstances in the last couple of years where the little girl has had to live with us extended periods of time b/c the mother cant or wont and when the mother says she wants her back she just ends up dropping her off at grandmas. The mother has not job and grandma pays for her apt and car as long as she can have the little girl and grandma also cashes the child support checks. What can we do? My fiance and I love her very much and can give her a stable family environment..there has to be something we can do. Please help.

You should consult with an experienced family law attorney to explore the grounds for a custody suit. There appear to be good grounds for success.
