Legal Question in Medical Leave in Texas

FMLA and ''Key employee''

My husband is on short term medical disability. we received a letter from his employer stating because he is a ''key employee'' the FMLA does not guarantee the right to be restored to his position at the end of his leave. If he returns and is terminated do we have any legal recourse?

There are not any exemption from FMLA for "key employees." FMLA coverage depends on the number of employees withing a certain geographical areas, tenure of the covered employee, and nature of the medical leave.
