Legal Question in Civil Litigation in Texas

Cat Lost - Due to neighbor's ignorance

Hello,

Recently my friend's pet cat was determined missing. My friend was informed by a neighbor that the neighbor was at work (almost 45 minutes away) and noticed the cat in the truck, but was late for a meeting and didn't return until several hours later. At that time, the neighbor noticed the cat was missing and has said nothing else of the incident.

It is of my belief that this incident would have never occurred if not for the negligence of my friend's neighbor in keeping his vehicle closed or at least having the common sense to not leave a cat unattended in his car.

One another thing I should mention is, I'm not completely sure of the neighbor's honesty due to the fact that it seems strange that a cat would be able to get out of a closed vehicle.

This brings me to my main question, is this the basis of a lawsuit of any sort based on the neighbor's negligence?

Thank you for your time and I look forward to a response.

Re: Cat Lost - Due to neighbor's ignorance

You don't have a case. All you have is a missing cat, and no proof whatsoever of what may have occurred other than a bit of hearsay.

If cats are left to roam free they sometimes disappear. If the cat is carrying its rabies tag and someone finds it, they'll be able to trace it back to your friend.

I'm not unsympathetic. I have three cats, and they are strictly indoor cats, having lost a few that were roamers.
