Legal Question in Civil Litigation in Texas

Can I file a civil lawsuit against the mand that molested my child. I live in Texas, this happen in South Dakota. states Attorney in SD siad my son did not articulate well enough to testify. Will not prosecute a case they can not win. My son has autism the abuse is documented.

Yes, you can file a lawsuit. If the abuse happened in South Dakota, you would have to file in South Dakota.
