Golf cart car accident

While on a recent vacation, my daughter, age 12 was driving a golf cart around a neighborhood. My boyfriend was riding with her. She accidentally ran into a van. The lady has full coverage insurance, but wants me to pay for her entire repairs rather than using her insurance. The golf cart of course has no insurance. The van's sliding door and window were damaged. What is the legal liability in this issue? And what should I do?

If your daughter is responsible for this accident, she (or you) is required to pay for the damage. The presence or absence of insurance does not make any difference in who is liable.

Your daughter is primarily liable. Secondary liability may lie with whomever gave her permission to run the golf cart where she could hit another vehicle. Your boyfriend may be liable as the supervising adult.

The fact that the injured party has insurance doesn't change the liability.

Contact your home insuror and auto insuror to see if there's any coverage. Otherwise it may well come out of your pocket.
