Legal Question in Civil Litigation in Texas

My husband and I did not get to name our son in the hospital. He is now 11 weeks old, and we've tried multiple times to name him at the county clerk's office, only to be given the run-around. On this last visit, they told us we must have some official documentation from either his doctor, daycare, etc. showing his given name that we have been using him and want it changed to. Of course the doctor's office won't provide us with anything besides his legal name (which now is Infant Of Franklin), and we do not use daycare. The county clerk said after we provide this illusive piece of evidence, we mail a form she would provide us to Austin TX and they would amend the birth certificate with his given name. Is this correct or is she giving us faulty infomation? How can we get this resolved?

I think the current name sounds cool. If you want to change it, go with the county clerk's approach. You should be able to get the birth certifcate from the hospital or from the bureau of vital records. The bureau of vital statistics website covers this issue in detail.
