Legal Question in Civil Litigation in Texas
Involved in a bad car accident where all medical expenses are covered by workers comp because I work for an auto dealer. Am I still able to sue the lady that hit me in civil court for pain and suffering, my wife having to tend my every need, I am in a hospital bed in my living room. Even though I won't have any medical expenses, I think I am still entitled to compensation for suffering, missing work is having an effect on my mental status (even tho I am being paid still). So can I sue and what are my chances?

Yes, you can sue. The comp carrier may also sue her to recover what it paid. Do you know how much insurance she has?
