Legal Question in Civil Litigation in Texas

libel and or slander

my wife has her own business and an employee was caught embellzeling money to cover hot checks. we have filed criminal charges againest her which are now pending. this employee, in her attempt to drive a wqedge between my wife and i has written a certified letter to us with a copy to the local police dept who is responsible for the investigation of criminal charges. in this letter she has accused my wife of having ''at least one adultress affair, and i(she)can prove this statement'' There is beyond any shadow of a doubt no basis. this is an attempt to create discord so we will drop the charges. can i sue for libel or slander?

Re: libel and or slander

You could sue, but you need to evaluate what your damages actually are and the ability of the ex-employee to actually pay any damges. Such suits are often not advisable because of the difficulty of proving and collecting damages.
