Legal Question in Civil Litigation in Texas

About Mediation or when there is an independent mediator

We have a lawsuit against a funeral service company. The lawsuit was handled through arbitration. The lawsuit was won, now only the settlement amount has not been disclosed. The comment was that the mediator would have to come up with the amount. Question, How long does the mediator have to make the decision about how much money the parties involved will get? Is it months or years?

thanks

fernando

Re: About Mediation or when there is an independent mediator

If the matter was settled in arbitration, the arbitrator should be able to give you the number, assuming you are one of the parties and entitled to know. The arbitrator can take as long as they like, although they usually give the judgment figure when they give the judgment.

Mediation is a completely different system, where the mediator tries to help both parties agree to a settlement. It's non-binding, the mediator doesn't make any determination, and the parties both know what the settlement is.
