Legal Question in Civil Litigation in Texas

Video taping a child without their knowledge

My situation is somewhat complicated....My daughter stayed with my parents at night when my husband and I were both working nights....My brother found a video tape of my daughter in the shower. My father had installed a video camera in the bathroom vent in the ceiling and was taping her whenever she was in the bathroom. The police were called and my father admitted to this disgusting crime. My question is....Do I have any legal rights and/or can I win a civil lawsuit against my father for pain and suffering for my daughter and the pain it has caused my husband and myself. My parents have money and I feel they should have to pay for all the counseling that could arise from this situation.

Re: Video taping a child without their knowledge

Absolutely. There was a large ($1,000,000) recovery in a case called Kerr v. Boyles several years ago, involving a young man who taped he and his date having sex, then showed the tape to his friends. I'd love to help you; you can reach me at 713-527-9190.

I'm so sorry your family has had this tragedy.

I believe that you have a cause of action against your father. You didn't mention how old your daughter is and that can also be a factor in your suit. Please call me and we can discuss this further.
