Legal Question in Civil Litigation in Texas

Wife took company PC, forensic found legal porn, divorce, need data returned

Home office (appears as such on Fed. Tax), we own several S corps., PC in home office primary business, 2 more pc's in home. Porn links fill favorites, along w/ travel site links, gambling etc., explained about spyware but hard truth is I had viewed LEGAL and NORMAL (lack of better word, meaning nothing bizarre). Wife took PC, gone 3 weeks, after repeated requests and need. PC comes back with all ''evidence'' (divorce grounds) deleted, a bootleg copy of an undelete disk in the tray (conclusion....was not up to DOD standards), and will not boot up. PC was taken 3rd week June, returned mid July.

Wife filed divorce. I am under discovery as our businesses all have substantial equity, PC had(s) Quicken, Excel, etc I could produce instantly, I want to leave it undisturbed in case I need it in the case. Forensic guy protocol says make perfect image before recovering. I asked her for a copy of orig. drive image. Says ''company'' made none, took off files, gave to her, done. It can be seen 2 days were active in the 3 weeks.

I concluded was person we know did her favor.Want to file civil litigation for image/compensation seperate from divorce, me and individual, makes my point, and useful aside in divorce. Need action w/ rapid potential.
