Legal Question in Civil Litigation in Texas

my wife was pulled over by a round rock police officer narcotics division he made passes at her and gave her his card saying you want to get together or talk call me while on duty. they met up one night and slept together he knew she is married and i have proof with text messages and phone records i notified the department and want to know what should happen to him and am i entitled to sue for destruction of my marriage.

Unfortunately you are not entitled to sue for any damages whatsoever. The Department is not responsible for the officer's actions in pursuing a personal relationship except in rare circumstances of specific types of abuse of his position of authority to accomplish his goals---AND ONLY your wife can make this charge. She, on the other hand, has committed adultery--and therefore you may be entitled to an unequal division of the marital estate in a subsequent divorce proceeding. I am sorry you are having to go through this but clearly she allowed herself to stray---meaning she was not feeling about your marriage and relationship the same way you were and you deserve better--you deserve someone who feels towards you the way you feel towards them. I know this is not what you wanted to hear, but unfortunately it is the law, at least until congress changes things. Good luck.
