I have had a request for a change in status pending for 2 years. Things between my spouse and I have gone south. I can get a divorce and file with someone else?

Be VERY careful. I recommend you not do anything without consulting with an attorney about your situation. If you mean by 'change of status' a family-based immigrant visa, there should be some concern about two years without any action. Getting a divorce would result in the I130 and I485 based on the first marriage being abandoned, and you probably out of status. There are time lags that could cause you problems.
