Legal Question in Insurance Law in Texas

Break In Retail store- Nationwide Ins

On July 24th, 2007 my store, The Forgotten Lore Anime, Comics and Gaming was broken into, merchandise and cash was stolen and the store with much of the product was damaged.

After 36 days of providing all paperwork and information needed to settle the case and provided Nationwide Insurance with all information requested, we were informed that that the claim still needs to be conference and that would not be done until Friday (August 31st) and they are invoking their right to 45 days to settle or investigate this matter further. The need for investigation is based on their initial mistake of reporting a $3000.00 claim instead of the true value of the loss.

Since we are a small business, and at this point, not be able to open the store for 36 days, we are in jeopardy of loosing our loyal customers, our retail space as well as our distributors, effetely putting us out of business and possible bankruptcy.

If this matter is not settled quickly, the loss will be great.

Your help in the matter would be greatly appreciated.

Re: Break In Retail store- Nationwide Ins

Our firm has handled numerous bad faith insurance claims on behalf of insureds like yourself, and we have experience dealing with Nationwide specifically. While I do not know whether we can speed up the claims process itself, it is sometimes helpful to have an attorney assist in presenting claims and in dealing with the insurance company. Of course, insurance companies don’t always find us to be helpful or necessary.

Your best course of action is to seek a qualified attorney who is experienced in bad faith insurance law to assist you as soon as possible. The area of bad faith insurance law is complex, and requires specific actions to be taken by the claimant within very strict time frames. Please feel free to call my office and speak to my legal assistant Ashley to set up an appointment if you wish to discuss this further, or you may email me directly at [email protected].
