Legal Question in Insurance Law in Texas

Who is at fault?

I was in a multi car accident and I only have libilaty ins. My truck was #3 in the 4 car accident,I was stopped at a red light. Who do I need to file against? First I was told to file on the car that hit me then I was told by his ins. to file on the person that made the first impact. Now I am not sure he has valid ins. because the ins. co. says the persons policy number does not match any of thier policies and he is not insured by them and I'm stranded with an undriveable truck and no answers. Can I get a rental truck? Who do i file against,my ins. tells me i'm on my own to file the claim.

Re: Who is at fault?

In the situation you describe, your claim would be against the driver of the vehicle behind you (who ran into you). If this person does not have valid liability insurance, you should file a "blue form" with the state to have their driver's license suspended. You may also file suit against them personally in Justice of the Peace ("small claims") court and you do not need a lawyer to do so.

Multi-vehicle accidents can be complicated with varying claims of liability. You did not mention whether or not you were injured. I recommend speaking with an attorney before trying to work the claim on your own. Most personal injury attorneys have free consultations.
