can someone that was in an automobile accident still sue you after they have allready sue the insurance company after 2 and half years?

I don't think I have all the facts here. Typically, you don't sue the insurance company for an auto accident. You sue the driver and/or the owner of the car at fault. The insurance will provide them a defense, and or tender limits. If the limits don't cover the damages, the injured party can go after the driver/owner for the excess. There is typically a two year statute of limitations, unless the injured party is a minor.
