Is an insurance company required to insure a person with a pre-existing condition out of medical necessity? Can an insurance company refuse to insure a person with a pre-existing condition?

Re: Should Insurance Company Pay

An insco may refuse to insure someone with a pre-existing condition unless there is a contractual waiver as is sometimes found in union contracts and for spouses of employees of large companies.

Generally an individual applying for insurance will be either rated up [charged a higher premium] or the condition will be specifically excluded from coverage.
