Legal Question in Intellectual Property in Texas

Competitor using our Trademark

A competitor is selling ''add-on'' products to ours and mentioning our trademark names. Their website does mention that the product names are trademarks of our company. Can we prevent them from mentioning our trademarked products and our trademarked company name at all?

Re: Competitor using our Trademark

You can and should prevent them from using your mark. This is your property, and if you do not protect you rights, your mark will be weakened. I suggest that you have your lawyer send them a strong "cease and desist" letter, claim for damages, and offer to license the mark. This might turn what seems to be a problem into an advantage if you wind up getting revenue from them as they provide publicity for your product.
