Legal Question in Intellectual Property in Texas

protection of idea for new use of copyrighted material

We want to suggest a new way to market someone else's copyrighted characters and related material. Is there any way to do this and ensure that we receive credit for the idea?

The idea would be similar to using the ideas in ''Charlie and the Chocolate Factory'' to create a themed store. The material is obviously copyrighted, but the specific idea of how to use the material is not being used. Beyond the difficulty of obtaining permission to use the material, how do we then protect our idea?

Re: protection of idea for new use of copyrighted material

You will need to enter into a licensing agreement with the copyright holder, and some ancillary contracts as well including a non-disclosure agreement while you negotiate the relationship. This is something that you need an attorney's help on, but can be relatively straightforward.
