Collective bargaining agreements

You have two collective bargaining agreements. One that is in effect when the employee is separated from the company due to a disability in which he is recieving benefits and the other that is in effect at the time of his death.One agreement substantially changes the death benefits. Which CBA controls?

The answer to this will depend on the provisions of the collective bargaining agreements themselves, but I expect that the CBA in effect at the time of death will control.
