Legal Question in Employment Law in Texas

corrective action

I was put into corrective action and a corrective plan for 3 months. I am 60 yrs old and affraid to loose my job over this issue, I did not agreed with the CA but my boss say I have no choice, I understand that each manager in my company has to put 1 employee in corrective action even if they don't have any employees that are bad performers, my health ins. after retirment is in jeopardy is if I get fired.

Can he really fire me I think that he violating some labor laws here by rating me a bad performer just fulfill a requirement from his managers of HR. they have to have a employee with a bad rating even if no one is really a bad perfomer.

Re: corrective action

It sounds like age discrimination. We would review your case if you like...but you need to go to EEOC..and if fired, you could have retaliation claim..but generally employers can fire without cause..and employees have to make claims for discrimination for age/sex/race etc..
