Legal Question in Employment Law in Texas

My employer hasn't paid us since May 2011. We get weekly emails saying that payroll is coming but it will be next week and it has now been 3 months. The company is an Austrailian Company. Can I take them to court to get paid, plus compensation for causing financial difficulties?

you may be required to go to Federal Court if amount is large/state court may not have jurisdiction...unless u were hired/have contract in Texs..an expensive delimma..
