Parent refusing to pay for childcare

I have a daycare from my home, and my policy states that even if you don't bring your child, for whatever reason, you still have to pay. I have a mom who is refusing to pay because she says that her lawyer told her she did not have to pay me because on the week in question she has court orders that her son has to be with his dad. Is this correct, or does she still have to pay because we have a contract?

The contract would win..BUT you may lose if you go to Court..ie cost $50 for JP/Small claims..time to go, and if you win, how do you collect?...and you may lose a client..so be prudent when choosing to go to Court
