Legal Question in Employment Law in Texas

Is standby time compensable time? I live in Texas and the company will often put us in standby mode waiting for more calls to come in to dispatch us to. It could be 1 hour or 5 hours in which they expect us to run the call if it comes in but they do not pay for the time spent in standby.

Depends on a number of factors such as (1) whether you are expected to be in "standby" mode while present on work premises; and (2) if you are at home and waiting, whether you are able to conduct your regular personal affairs. If you are present on work premises while on standby mode or if there are stringent restrictions while waiting at home, you may have a case against your employer for wages. You may contact the Texas Workforce Commission or an employment attorney to evaluate the claim.
