Wage Withholding

I was terminated about three weeks ago. My boss will not send me my last pay check because he said that he needed to find the value of some merchindise before he could send it to me. It was taken to the point where my vehicle was searched several times without me being there and i was accussed of stealing but, nothing was proven. The police were called and they as well did nothing. At that point my boss told me i was fired and to leave. I need to know how to get my check without the deduction or what to tell him if it is not legal to withold my check. I was not aware that legally he could hold it for more than the following pay period. What can I do?

Re: Wage Withholding

Sounds like a possible violation of the Texas Pay Day Act. Without prior authorization, the employer should not with hold from the last paychecks the value of missing items. A "Wage Claim" should be filed with TWC.
