Legal Question in Landlord & Tenant Law in Texas

Eviction for nonpayment of rent

I had to give an eviction notice to a resident,on name i put (1) resident's name and occupants.Resident returned all her keys and moved her belongings instructing me that her boyfriends belongings were still in apartment which i verified and that she did not know of boyfriends location. Both residents are on lease and signed.Since she moved and i didn't put his name on eviction notice(only as occupants)will i have to re-issue a notice giving his name and occupants or put both names. He's not there often and has been kicked out of her apt.by her many times although not formerly removed.Since she moved i'm thinking that i can not file on her but must reissue notice to insure his eviction being that i know he has not and will not pay rent.Am i right in my thinking so as not to incur a lawsuit for filing on a non resident?

Re: Eviction for nonpayment of rent

If his name is on the lease, he should receive an eviction notice. If he is not on the lease, he is a trespassor.
