Legal Question in Landlord & Tenant Law in Texas

Hi,

What is the limit on late fees that a landlord can charge? I know the Texas statute says "a reasonable estimate of uncertain damages." But what is reasonable?

My rent is $1000 per month. He is charging me $1000 in late fees. However, today I learned that he is adding another $400 from another month when I was late. He never charged a fee before.

I have rented from this landlord since September. I don't have a lease.

Thank you for any assistance you can provide.

Pat

Generally late fees are dictated in the lease agreement. You should refer to the lease agreement to determine the amount of late fees.

You should consult with an attorney for a more in-depth analysis of your situation.

Good Luck!

If there is no lease, the fee that can be charged should be determined by statute. You need to consult an attorney on this.
