Legal Question in Landlord & Tenant Law in Texas

House Forcloser

My daughter moved out of her home almost 2 years ago, her husband kept the house. About 2 weeks ago he told her he was moving and if she wanted the house she could move back in there with the children. So she gave up her place and moved back in the house. The part he FORGOT to tell her is that he has NOT paided any payments since she left! HE had gotten a 3 day notice,, last Monday!! HE called and told her On Saturday. She had Just gotten everything transfered in her name. (Lights and Phone) She also has a 3 week old grandchild living with her now. My question is CAn they lock the doors on the home before she has a chance to get out of the house? We have been told that they might be able to hold everything in the home. Can they do that? She is looking for a place now.Thank you for your time. Please help!!

Re: House Forcloser

If the house has been foreclosed, your daughter is entitled to notice before she can be evicted. The owner may not lock her out. She should have about ten days to move. Larry Maun 713.266.2560
