Does a person who does not pay rent nor have a lease have any rights to the residence?

I will assume that this is a person who LIVES on the premises (you didn't say).
He is probably a "tenant at will" and must be evicted through the Justice Court. Assuming that it didn't work when you asked him politely to leave.
