Legal Question in Landlord & Tenant Law in Texas

Searching for a house I saw one I liked and talked to the realtor, everything is great I give her a 1400 cashier's check in name of the house owner and the next day I find out that there is another tenant living in his garage. I definetely tell him that there is no deal since he never shared this information with me. I find out he cashes the cashier's check, but he tells me no problem, that I would receive a personal check for the same amount in a couple of days. It has been 3 weeks and still nothing. Eventhough I contact him and he keeps on telling me that it is on it's way. Both realtors who were in the transaction ( his and mine) do not help me either and just say the same as him " It is on it's way". The nerve !!! and the realtors do not match to their stories. One says that they have a meeting with the owner and the other one says he has the flu, the wife has the flu and he daughter too,( reason for not mailing my check). Best of all I call the owner and he is not even sick or aware of a metting. What can I do?
