Do we have the right to sue?

Recently me and my mother were evicted out of our apartment, due to minor disturbance. We have been living in our apt for five years, rent was always on time, and no problems with us as tenants.

When we were evicted, my mother paid the reletting fee, and thought everything was squared away, when we move to a new place we shouldnt have any problems because we do not owe them any money and we were good tenants nonetheless. We applied for a new apt and were denied. My mother called the old apt place because she figured they had something to do with it, and sure enough,they claimed that we were not in good standing with them far as money went, they said my mother owed them the reletting fee. My mother has a copy of the check she paid them for the fee so everything would be good, but my question is, do we have the right to sue, for defamation of character ( them putting us down to the other apt place and basically that was the reason we were denied). or is there something else we can do?

You might have a cause of action against the apartment company. My recommendation is that you provide the aparment company photocopies of the cancelled checks showing the reletting fee was paid ask them to have your credit record corrected and to notify you when they have done so.

Keep copies of all your correspondence, send everything certified mail, return receipt requested. If the apt. complex does not corect their mistake, then find an attorney.
