Legal Question in Legal Ethics in Texas

professional responsibility

In 2004 I had an auto accident 12 days after a spine surgery which caused me to be left with nerve damage. My lawyer recieved pymt from my car insurance in june'06 and pymt from the insurance of the car that hit me in jan'07. I was told it would take a couple months to distribute the monies to the insurance providers and then I would recieve my part. I've been calling once every 2 to 3 months since April'2007 and can not get a response from my lawyer or his office. What can I do? I have never been informed by phone or mail how much the settlement was for. I feel I've been left out of the whole process. Is a year long enough to distribute monies? I also question if he can raise his rate from 33% to 40% and never inform me that it would change. How can I get this resolved?

Re: professional responsibility

A year is most likely far too long. You need to contact the texasbar com and report your attorney for not responding to you and for possibly having misappropriated your funds. This one of the main ways that lawyers lose their license.
