Legal Question in Medical Malpractice in Texas

Failed Back Surgery

I had spinal fusion surgery in June '08. They implanted rods and screws and cages into the disc space to hold the horomone for bone growth and fusion. I continued to have extreme pain and they all said it was normal and apart of the healing process. After contined pain they did a MRI in November. The doctor stated the cage had moved or migrated out of the disc space and was pressing against the nerve thus the pain. He said the only option was surgery so I was again subjected to a very hard back surgery to correct the problem. I am wanting to know if this could be due to a medical mistake such as the cage was not the proper size for my disk space or was not seated properly. I have lost much time and money and continue to have pain. Please advise.
