Legal Question in Medical Malpractice in Texas

) believe I have a good case for malpractice. I had surgery on my ankle back in February. Within a day or two I developed pneumonia in both lungs. My temp went to 103 and my oxygen level was at 85%. The emergency rapid response team immediately started "stat" xrays and CT scans. I was completely confused, babbling incoherently and thought I was dieing. I wound up in ICU.

I had a visit by the hospitalist (doctor who takes care of patients during the hospital stay) and I asked him why I developed pneumonia so quickly after surgery. He told me and I paraphrase "due to mismanaged airway during surgery". This layed it at the feet of the anesthesiologist. A patient is supposed to be interviewed personally by the anesthesiologist before the surgery to get a medical history from an anesthesia view. I never met or saw such a doctor.

Do you think I need a malpractice attorney? How long can I wait before filing a suit (one year or two?)

Should I return to the hospital and ask the hospitalist about his statement to me in ICU? How could I pull this off without alerting him to a possible lawsuit?
