Legal Question in Medical Malpractice in Texas

Nail left in knee

I want to know if I can take any action against the military hospital for leaving a corroded nail in my knee and than causing more injury to my knee.

While I was active duty I had a nail go through my left knee and I went to the Emergency room for care. After X-rays and being cleaned up because they said my X-rays showed nothing I was sent home. A day later after my knee was turning black I was called by another doctor from E.R stating I had a nail in my knee and I had to come in. Well, after my ortopedic doctor showed up and realized the nail had caused damage and could not be removed I had to have emergency surgery. Since than I have had another surgery and forsee more to come.

I don't believe the doctor on duty that night saw the x-rays and for that I could have lost my leg.

The nail was very clear in the X-rays and all other doctors that have seen it can not figure how it was missed.

I am now retired and was told that I should try and seek compensation. What are my chances?

Re: Nail left in knee

Depends on how long it's been since you found out about the nail. How long ago was it?
