Legal Question in Medical Malpractice in Texas

I had a root canal and have had constant problems since. I complained to the dentist that performed the procedure and was told by her on four separate occassions that everything was fine and I was brushing/flossing too hard. She since left the practice. Months later my first time seeing my new dentist I was told everything was fine and it just needed time to heal. Went in for a routine cleaning, complained yet again for the pain. My dentist was not there so they sent in yet another dentist. He took one look at my xray and said the problem was that one of the files used in the root canal was left too long and it was protruding into my sinus. Referred me to an endodontist. Was told the same thing. In one root the file was left too long and was in my sinus, in the second root the filler had leaked and I now have a foreign body that my body will "hopefully" absorb. Not what you want to hear. Endodontist said there was nothing to do at this point. In order to repair damage I would need surgery which could lead to further complications since in involves my sinus.

So in a nutshell I have to live life with a constant throbbing in my tooth and my left jaw hurting 50% of the time.

Do I have cause for a settlement or suit?

Get copies of all dental records. Contact dental malpractice attorney. Records will need to be reviewed by a dentist to see if there is malpratice or just known complications from the procedure.
