Legal Question in Medical Malpractice in Texas

I had a root canal done by me dentist because my insurance wouldnt cover it being done by a specialist! My dentist could only half way do it, because the feeling of pain came back and the numbing would not work any longer. So they gave me different meds to take for the pain and to contact them in the morning if it was worse or better. When I got home from the appt. my dentist called and told me he called in a favor to the specialist my insurance wouldn't cover, and that they would do the rest of the procedure at no cost. Which was nice to hear! However he began to say that he was taking another look at the x-ray and noticed that he left a small piece of instrument behind one of my roots he was repairing? When I asked what kind of instrument he said it was just a tiny piece that the specialist would also have to dig out. Now I have been in pain, I've had constant headaches, and constantly want to sleep, but I do not feel comfortable about suing. But if malpractice is the case here, I would just hate to see someone else go through what I have been the past 2 weeks. Not to mention the specialist cant even see me for another week.

You need to see another dentist and get this issue resolved quickly. Leaving any foreign body there is not good for your health.

If you decide litigation is needed, save all emails, voice messages, get anything and everything in writing. Discuss this with an attorney. As you said, you would not like anyone else to go through this.
