Legal Question in Medical Malpractice in Texas

who can sue

In a malpractice suit, who can sue? I have heard the parents, the spouse and the kids can enter a lawsuit together. If the spouse sues does that person have to have the parents sign a release from further action. The patient in this case was 42 and the lack of care resulted in death. The spouse is telling the parents they can not sue, but I'm thinking they can be named in the suit also.

in texas the wrongful death statute provides that a spouse, children, parents of the deceased and the deceaesed's estate can sue for wrongful death. i hope this helps, bill featherston
