Legal Question in Military Law in Texas

my brother joined the ANG and completed basic training. recently (july 27th) he went AWOL from AIT in texas. He was having family probs back home (wife got arrested) his kids were taken into DSS custody 3 days prior to it even reaching his ear. he tried to get leave but he was reclassing MOS's and was alrdy signed out of Ft. Sam so his DS's said there was nothing they could do and to talk to his new CoC when he reports to his new state. Instead of reporting (had to report on Aug 1.. notice 4 day span from his awol) He called the airport to cancel his army paid ticket to his new loc and instead went home to fix his problems. (Hes been gone over 30 days obviously.) How bad is his situation and can he stay in the army rather than be discharged??

Your brother's situation is not good. I recommend he return to military control soon. The military will decide whether your brother should be court-martialed or given non-judicial punishment once he returns to military control. I recommend your brother have a lawyer or GI Counselor to support him through this situation. There are many issues present in his situation.
