Legal Question in Military Law in Texas

Question regarding awol

Iam not in the army but I had some questions requarding my boyfriend who went awol 5 months ago. He ecaped and retured back home. He was arrested yesterday for a warrent the army gave him. I needed to know the procedures that he is going to go through. I also wanted to notify the army that they should have never allowed him to join because of his mental illness. He has bipolar disorder since he was a child and has been hospitalied several times for his illness. If you can please respond back and give me some information on this issue.

Re: Question regarding awol

Based on what you have written, dependent upon whether or not your boyfriend disclosed his mental illness during his enlistment process, he might potentially be facing other legal matters if this is disclosed now at this point. If he did disclose this, his attorney might use that disclosure to assist you boyfriend (if applicable). The best thing currently, is for you to be there for your boyfriend and help him get through this process. If my law firm can assist you with this legal matter or any other legal issue, please contact my legal assistant Jennifer ([email protected]).

Re: Question regarding awol

I would encourage you not to communicate with the Army. If your boyfriend has bipolar disorder and failed to disclose this during the history part of his physical, he might be charged with fraudulent enlistment in addition to AWOL and desertion. The last thing he needs is more trouble.

He will be permitted visitation in the brig wherever he is, and you can support him best by going to visit him. He may be administratively discharged, and he may be jailed for a time as a result of not returning to duty (desertion).

He needs to finish this with the Army, and then the two of you can have a life.

In the meantime, I am sure he needs your love and support.
