Legal Question in Personal Injury in Texas

Assault on woman

My ex-boyfriend gave me a black eye 3 weeks ago. Is it too late to press charges? I have pictures and a witness.

Re: Assault on woman

No. Let the police or the DA make the decision. You may have to explain why you waited 3 weeks.

Re: Assault on woman

You should consult with the DA. Also consider taking other steps to protect yourself from future violence from this man.

Re: Assault on woman

Your question is actually two fold. One there is a criminal prosecutorial question. The other two lawyers above have adequately addressed that issue for you. Secondly, there is a question of your right to sue this person in civil court. The proper cause of action sounds like it may be ASSUALT. Assualt is an intentional tort and is usually not covered by liability insurance. This reality creates a problem in most cases because the offending person likely does not have any meaningful non exempt assests against which you could collect any damages.

There is a 2 year statute of limitations on your right to sue the person for civil damages. Consult a lawyer for a consultation regardingthe financial realities of recovering any money against this person.
