Dog Bite Suit

My son was bit by 2 rottweiler dogs. The dog owners are a married couple and are currently seperated. I sued the husband for medical bills he agreed to pay and has not, but is now in jail. Can I sue his wife for the medical bills since her husband can not pay?

Cases such as yours are predicated upon your being able to prove negligence. If the wife was not even living with the husband, it is doubtful that you could prove she was negligent in allowing the dogs to attack your son. However, if the couple have a homeowners insurance policy, that policy should cover the negligence of either one of them under these circumstances.
