Legal Question in Personal Injury in Texas

Hit by unlicensesd driver

My daughters were rearended by an unlicensed 16 year old. I have spoke with the insurance co. I am waiting to hear from the adjuster. The driver had his mother in the vehicle with him. Can criminal charges also be filed since he and his mother were intentionally breaking the law? Damage to car and daughters is going to be extensive.

The driver will most likely be cited for driving without a licensed and for any other traffic violations committed. Given these facts, I don't see a situation where he could be charged with a serious crime. However, on the civil side you do have some better prospects of recovering for your injuries.

How bad are your daughters hurt? This could play a role in your pursuit of criminal charges. How old was the driver? This could be a factor. Any idea why the mother was allowing an underage person to drive her vehicle? Was alcohol involved? Was the underage driver hurt? You may be able to pursue her criminally for injury to a child. However, I need more information.

On the civil side, there could be coverage issues. In any event, you have a very strong case on the civil side that you can pursue to remedy your situation.
