Legal Question in Personal Injury in Texas

My mom is being sued for a car crash she wasnt involved in. I was driving her car and got into an accident. but the claim says she was driving and she wasnt even there! they are suing her as if she was the one driving saying she was neglegent by turning inot the lane without looking. can she countersue for defamation of character.

Suing someone by mistake doesn't constitute defamation of character.

Contact the party that is suing your mother and your insurance to let them know about the situation. If you were involved and you were not listed on the insurance then they can sue your mother.
