Parent�s responsibility for kid's misbehavior

If a minor (approx. 9 years old) injurers another minor (approx. 11 years old) by shooting him in the eye with a pellet gun - Can the parents of the boy with the pellet gun be held liable for the other child�s emergency room costs and surgery expenses?

If so, what are the first steps in pursuing this route?

There are a few different theories of liability. The first step is to determine who was supervising the children at the time. Also, you need to determine if there is insurance available, and see how it applies. If you haven't sought legal counsel yet, you should do so immediately. Your first step should be to hire a board certified personal injury lawyer. A nine year old should not have access to a pellet gun. So you could argue the parents were liable for allowing their son to get his hands on the gun.
