Property owner won't provide insurance information

While leaving a theme park at night, my wife fell into an unmarked, ungaurded drainage culvert. I've attempted to get the landowner to provide me with their insurance information but they just keep telling me they've filed a claim and it's up to the insurance company to contact me. They refuse to provide me with that info. It's been nearly 2 weeks and I still haven't heard from the insurance co. What can be done to get them to provide me with their insurance info?

This is an old insurance company trick. Basically, they delay giving you information or give you the run around for a few weeks. Then, while waiting, they bank on your not seeking medical attention. They will later use that against you, claiming that if you had been injured, you wouldn't delay seeking treatment. I'd suggest your contacting an attorney for a consultation. Sue them. They have no obligation to provide you any information until a lawsuit is filed. Sometimes property owners do the right thing; sometimes they have to be forced to do the right thing.

With all due respect, you are in way over your head trying to handle a claim like this by yourself. "Premises liability" claims are among the most difficult cases to prove and win in Texas. (For instance, did you know that to win this case, you must prove that the theme park operators knew that the culvert cover was missing BEFORE your wife fell into it? Knowledge of the defect is an essential element of a premises liability claim. If some kid removed the lid and you can't prove the theme park operators knew about it before your wife's fall, there is no liability on the part of the theme park. This is just one of several very difficult elements to prove in this kind of case.) You should contact me or some other competent personal injury attorney immediately.

You should hire an attorney. If they will not answer the lawyer, then the lawyer can file a lawsuit. After doing that, a judge will make them give up the information if they try to avoid cooperating.
