Legal Question in Personal Injury in Texas

Hi my father just passed on 07/20/09 at work we are still waiting on the autopsy which the Justice of Peace stated that it will take 3 to 4 weeks. Okay my question is that my father didn't have a will and he just married 9 months ago my father bought his home and vehicles before their marriage I want to know legal part of this. He has two children my older sister and I. I don't want her to sell anything of his or give his property to some of her family so my question is what are his kids legal rights in this matter?

When my dad died he died at work OSHA was called out and shut the plant down. It is still under investigation. He was found dead at 5:30am and the justice of the peace was called at 6:30am. My step brother went to pick up his truck from the job (because JP already pronouced him doa at the scene) well my step brother stated that my dad keys were in his truck and that is unlike my dad. He would never do anything like that at all. Also we were told he was the only one at his station but it was a two man job that my dad was doing so we wanted to know where was the second person but no one is able to answer our questions. We are clueless on what to do but we were told that we should persue a wrongful death suit. So my question is what steps should we take in this case?

Whether there is a case to pursue depends on his cause of death. Have the autopsy results come back? If not, has anyone given you any indication of how he died?
