Legal Question in Personal Injury in Texas

Recourse after drinking coffe with a roach in it?

I bought a cup of coffe while stopping for gas. A roach came through the hole in the lid. It made sick when I saw what it was, and spat it out on the lid.

Do I have any recourse such as sueing for dammages since I got sick, and will never ever buy another cup of coffee while traveling.

Thanks in advance

As a personal injury lawyer, I get asked questions like this often. I'm sorry for what you went through, but I'm glad to have this opportunity to answer this question for you and others who may have suffered a similar fate. The answer to your question, "Can I sue?" is yes. However, the answer to the question, "Will I get a lot of money?" is no. Even though your experience was unpleasant, it did not result in any damages. You were not injured, did not go to the doctor, and it is very doubtful you'll require psychiatric care (although your taste for coffee has probably waned somewhat). A jury would simply not be moved to award any significant damages. In my experience, such a case is usually worth $300-$1000 at most. Because of the low value, few attorneys would be willing to take such a case because the time required to pursue it would far outweigh the potential recovery.
