Legal Question in Personal Injury in Texas

Responding to a civil accident suit

I am a Disabled Vet with 8 kids. I can't afford an Attorney. I am being sued by a large insurance company. They paid 31K to their insured. She was not wearing a seat belt. How do I defend against this? Texas has a primary seat belt law for the front seat, but compliance is inadmissable in civil suits. She would not have been injured, or much less severely with a seat belt. Plaintiff say's that I was neglegently operating my vehicle and failed to maintain a proper lookout. Can I slow them down by requesting production of every thing they have? Requesting medical records, etc?

Have you filed an answer, if so, then yes, you need to conduct discovery.

Mr. Baez advice is good. Sounds like you have the time to do this. Spend some time studying up on discovery and don't panic. You might send them a copy of your income tax return and a property report. Sounds to me like you might be difficult to collect $31K from. Maybe they would see the same picture. Although some of those guys just want to get judgments to put a notch in their gun. Good Luck.
