What Are My Rights In Settling My Case

I'm trying to settle an injury claim with Farmers Insurance related to an accident I was in with their insured. The case is almost 18 months old and I've been working through an out of state attorney to get it settled. Farmers is stonewalling me. Attornies I've spoken with believe it is not worth filing suit as the settlement is anticipated to be less than $10K. What are my rights to a fast and fair settlement? Am I facing any time limits?

Why is an out of state attorney involved? Was the accident out of state? If so, then the law of that state will apply to your claim and cause of action. In Texas, there is a two year statue of limitations on a personal injury claim. If you wait another six months, Farmers will owe you nothing and they are hoping that you do just that. Check with attorneys in your area and see if one would be willing to take the case to trial. Stop trying to do it yourself.
